Afternoon Drive: In-state CSU football commit takes a shot at CU Buffs

1. Fighting words

Verbal commitments to Colorado State's football program don't get much attention on Buffzone, and rightfully so, it's called Buffzone. What Pomona High School offensive lineman Zach Stefo had to say upon his announcement of intentions to sign with the Rams, though, ripples the recruiting waves around the University of Colorado.

"I could have gone to CU, but I'd probably have lost for the next five years. CSU has a bright future and coach McElwain has established a great base. I trust him for the next five years," Stefo told the Coloradoan on Tuesday following his pledge to the green and gold.

Stefo is a 6-foot-5, 270-pound recruit out of Arvada who projects himself as a tackle at the collegiate level. He is unraked by the major recruiting services and his other reported offer was from New Mexico State. Stefo jumped on board with the Rams following a skills camp at CSU last weekend.

Is this mild-mannered fun on the recruiting trail or the sentiments of in-state recruits? Colorado has verbal commitments from Longmont offensive lineman Isaac Miller and Aurora safety Evan White -- who reports via his Twitter account that he ran a 4.48 40 today -- for its 2014 recruiting class, so obviously not all in-state recruits feel the same way as Stefo. If anything it's bulletin board material for the Rocky Mountain Showdown.

2. Holy Ducks

Did you see the new facilities the University of Oregon? If you haven't, grab a tissue because you're either going to be drooling or crying. The Ducks' new digs made the rounds on the Internet this morning and truly are fit for a king. See what $68,000,000 can get you.

3. Game on

The NCAA and video game giant EA Sports ran into a hurdle today in the on-going legal battles regarding profiting off the use of players likenesses. CBS Sports reports, "a circuit court of appeals rejected game manufacturer Electronic Arts' claim that its use of player likenesses in its football game is protected by the First Amendment in a lawsuit brought by former quarterback Sam Keller. The move is seen as significant in the case going forward, at least as it applies to a Keller's suit brought against EA and the NCAA."

Remember Sam Keller, former quarterback for the Nebraska Cornhuskers? Keller filed his lawsuit in May 2009 and Ed O'Bannon and his crew filed their class-action lawsuit in January of 2010. The NCAA is looking at writing out some large checks in the near future.

4. Pac-12 Network expansion

If you live in the Midwest, have Comcast as your cable provider and love the Pac-12 conference, you're in luck. The company is set to roll out Pac12Nets on Thursday in the heartland of the country, most specifically in the greater Chicago region. Next stop, east coast.

5. Nick Waisome, law enforcer

Burglars in Tallahassee, Fla., picked the wrong guy to mess with when they broke into the home of Florida State defensive back Nick Waisome. Waisome chased down the two intruders, leading to the arrest of one of the men. The other burglar got away, but Waisome helped in his arrest by calling the Tallahassee Police Department three weeks later after seeing the suspect at a gas station wearing his stolen shorts.

Miami Dade College and the public schools system team to train students for jobs in transportation in the wake of the Panama Canal?s 2015 expansion

Multi-billion-dollar expansion projects at Miami International Airport and the Port of Miami, a major expansion of the Panama Canal, along with a $900 million project to expand the Cuban port of Mariel into a strategic shipping zone in the Atlantic, could foretell a boon for jobs in the transportation industry through 2020, experts predict.

Projected job openings for logistics engineers, which can start at about $39 per hour, could top 48,000 positions, while logistics managers could fill about 34,000 jobs.

Miami hopes to secure a piece of that action through a program to be presented by the Miami-Dade County Public School System, Miami Dade College and the Miami Dade Beacon Council. The Transportation Academy, at three Miami-Dade schools that are yet to be determined, aims to prepare the local workforce for the expected demand at the Miami International Airport and Port of Miami. The initiative, aimed initially at the high school level, is geared to drive interest in transportation opportunities, such as logistics and supply chain management, especially among minorities and women.

Miami-Dade?s School Board expects to name the participating high schools in August, says Cristian Carranza, administrative director in the school system?s Division of Academics, Accountability and School Improvement. ?We?re planning to offer logistics in the Transportation Academy to approximately 500 kids to prepare these students for the emerging areas in transportation.?

The rollout would feature two schools in the county offering the curriculum in the 2013-2014 school year ? one geared toward the Port of Miami, the other MIA. The third school, envisioned as a stand-alone global logistics track, would come onboard in 2014-15.

?The state of Florida has identified major opportunities to increase its role as a major trade hub and we want to align ourselves,? Carranza said.

Indeed, the airport?s $6.5 billion capital program includes new terminals, an upgraded baggage-handling system and people mover. A $50 million rail project to rehab tracks and improve links from the port to the Florida East Coast Railway yard near MIA is also underway, along with the addition of 15 acres at the port for three parallel rail tracks to accommodate half-mile-long trains.

There also is the $915 million port tunnel, which is under construction in downtown Miami, designed to whisk trucks that use the interstate highway to the port and alleviate traffic congestion. At the same time, a $150 million dredging project to deepen the channel by 50 feet will help accommodate larger cargo ships expected in the wake of the Panama Canal expansion in 2015, which is expected to transform the shipping industry. The 48-mile canal connects the Atlantic and Pacific oceans, and is a key passageway for international maritime trade.

?The idea for the program creates a pipeline of talent to address the workforce demand we are seeing in international trade,? Carranza said.

The high school students who engage in the Transportation Academy will funnel into an educational pathway at MDC, which will have new degree programs in transportation logistics and supply chain management.

?It is business-focused,? said Thania Rios, associate dean for MDC?s School of Business. ?Those [magnet high school] students would come to college with some kind of certification. When we did the proposal for degrees, someone graduating can make about $50,000 to $60,000 to start. We?ve worked extensively with the industry to form these programs.?

There are many certifications within the industry, Rios said. Gaining early knowledge through the Transportation Academy can give locals a leg up.

?This will allow them to zip through a lot of those exams,? she said.

The county is scrambling to shore up its transportation capabilities, with deeper port waters and rail, for instance, so it can be competitive once the Panama Canal expansion is completed and ascend to prime position as a gateway port. Ports from Miami to Columbia are all anticipating the transformation of the Panama Canal, which will unleash considerably larger cargo ships.

?We?re really hoping those super vessels will come to our port because we are able to support them,? Rios said.

Broward College in Fort Lauderdale also recently received state approval for a new transportation baccalaureate degree, bringing a total of four institutions readying the workforce. The others are the University of North Florida in Jacksonville and the University of West Florida in Pensacola.

Antioxidants Don't Boost Women's Fertility, Major Review Finds

Despite showing promise in boosting male fertility, there is no evidence that antioxidant supplements improve women's chances of having a baby, according to a review of 28 studies.

At least 12 percent of women of childbearing age experience infertility, according to national estimates. That does not necessarily mean they will never be able to conceive, but they have been unable to do so after having unprotected sex consistently for one year, or for six months for those age 35 and up.

Women seeking treatment for infertility sometimes take dietary supplements and antioxidants -- vitamin C, vitamin E, melatonin, or combination supplements, among others -- in the hopes of boosting fertility. But the new Cochrane review, published Sunday, found little evidence supporting efficacy of the supplements.

"I don't think the results were surprising in the sense that there are no national organizations or guidelines that recommend routine use of antioxidant supplements for fertility," said Dr. Wendy Vitek, head of the fertility preservation program at the University of Rochester's Strong Fertility Center, who did not work on the new review.

"But I definitely have women ask me about supplements," Vitek said. "I think there are a lot of feelings of self-blame with infertility, and women are looking to gain some sense of being proactive and of potentially controlling a very uncontrollable situation."

Antioxidants, found in many fruits and vegetables, can also be taken in pill form. Antioxidants can help reduce oxidative stress, which occurs when free radicals damage cells and their ability to function. According to background provided in the Cochrane review, oxidative stress can be brought on by many of the same conditions that contribute to infertility, such as ovulatory disorders and endometriosis.

"It is thought that the free radical 'scavenging' effects of antioxidants would help to repair any oxidative stress occurring in the female reproductive process," lead researcher Marian Showell, with the University of Auckland's department of obstetrics and gynecology, told The Huffington Post. "This has not been disproven by this review. We just didn't have high enough quality evidence to prove or disprove it."

All told, the studies included in the review included more than 3,500 women who were attending fertility clinics.

An earlier Cochrane review, on which Showell was also lead researcher, found that antioxidant use by male partners in couples undergoing fertility treatment was linked to higher birth rates, although the researchers cautioned that placebo-controlled studies would need to confirm the finding. The theory is that antioxidants help improve sperm quality by reducing oxidative stress, which could have a big impact, given that 30 percent to 80 percent of cases of male infertility are due to such sperm-related problems caused by oxidative stress.

Resolve, the National Infertility Association, estimates that one-third of infertility cases are attributed to the female partner, one-third are attributed to the male and the remaining third are caused by some combination of both partners, or are simply unexplained.

"Oftentimes, patients latch on to something they heard made a difference for this person or that person," said Vitek, who said there may be some secondary gain from the placebo effect of taking antioxidant supplements. But in general, she counsels women who are undergoing fertility treatments to simply adopt as healthy a lifestyle as they can -- to exercise and eat well and attempt to manage their stress.

Although the new findings on the limited benefits of antioxidants are not necessarily surprising, they are slightly disappointing, she said.

"It would be nice if we had easier answers for women," Vitek said. "It would make everyone's lives easier if we could say, 'Here, take this supplement.'"

Won't be deterred by attack in Afghanistan: India

NEW DELHI: Hit by yet another suicide bomb attack on its mission in Jalalabad, India on Saturday said "terror machines" that operate from "beyond the borders" was the main threat to the security of Afghanistan and refused to be deterred from its commitment to assist the war-torn country.

At least 12 people were killed in the deadly attack targeting the Indian consulate in Jalalabad city, bordering Pakistan, in the backdrop of reports that the ISI-backed Haqqani network among others were again plotting to attack Indian interests in Afghanistan.

"This attack has once again highlighted that the main threat to Afghanistan's security and stability stems from terrorism and the terror machine that continues to operate from beyond its borders," ministry of external affairs spokesperson Syed Akbaruddin said.

He said the attack which has led to the injuries and deaths of several valiant Afghan police personnel as well as deaths of several innocent Afghan civilians including children, must be condemned in the strongest possible terms.

However, he asserted that India would not be deterred by this attack and will continue to assist Afghanistan in its reconstruction and development effort.

"This was clearly an attack not just against India but an attack against the efforts to help the Afghan people overcome the tragic hardships they have endured due to several decades of war," he said.

This is the second strike on the consulate which was earlier attacked in 2007. Indian embassy in Kabul too came under a deadly attack in 2008 and was again targetted in 2009.

Pakistan-based Haqqani network, described by a former US military chief as the "veritable arm of ISI, has earlier been found to have carried out the attacks.

It is understood that Indian government had inputs about possible terror attacks against its consulates including the one in Jalalabad following which a team, comprising security officials, visited the consulates and the embassy in Kabul last week. Apart from Jalalabad, India has consulates in three more places ? Herat, Mazare-i-Sharif and Kandahar.

As per the recent intelligence inputs, apart from Haqqanis, the security threat was also from smaller militant groups based in Pakistan.

Meanwhile, Akbaruddin said India wishes to express its deep gratitude to the brave Afghan security personnel who laid down their lives while protecting the Indian consulate.

"We wish to express our grief and condolences to the families of the innocent Afghan civilians who also lost their lives during this attack," he said.

FOX Sports has named Julie Stewart-Binks as the host of their brand-new daily soccer show, FOX Soccer Daily, that?s scheduled to launch on August 19.

Stewart-Binks was introduced as the new host during half-time of Saturday night?s broadcast of the Everton-Real Madrid match on FOX. The female presenter will be joining Warren Barton, Eric Wynalda and Brian McBride on the show.

A former sports anchor and reporter specializing in ice hockey, the Canadian previously worked with FOX Soccer in Winnipeg for four months from July-October, 2011 where she trained as an anchor and was responsible for writing and editing highlight packages.

Stewart-Binks joined FOX Sports 1 this summer, and is one of several women with blonde hair that the Rupert Murdoch-owned company has hired to work for FOX Sports 1 (along with?Charissa Thompson, Erin Andrews and Molly McGrath). Sky Sports, also owned by Murdoch, employs a similar policy of hiring attractive women to present their sports news programs. Hopefully she knows her soccer too.

Making the playoffs every years since 2009 pretty much says a team has plenty of fantasy options.? The Green Bay Packers look to take aim at their third-straight NFC North division title.? Their core is in its prime and they have some quality players behind the scenes as well.? Which names should drafters look out for?

Offense ? Aaron Rodgers

Anybody who is surprised by the first two selections in this article should really re-evaluate their stance on watching pro football.? Aaron Rodgers is arguably the best player in the NFL, let alone the best fantasy option on the Green Bay Packers,? He piles up passing yards and touchdowns like a pinball machine and even is a threat to add some points in the rushing game just for flavor.? There is a slight risk in him getting hurt given the instability of the offensive line but with so many weapons including a new running game, there is no reason to think the real A-Rod won?t Discount Double-check his way to another MVP-caliber season.

Defense ? Clay Matthews

Besides maybe corner Tramon Williams, Clay Matthews was the obvious choice.? He is perhaps the best rush 3-4 linebacker in football and the most consistent threat the Packers have on a defense that tends to get by on scheme more often than talent.? Matthews is durable, smart, skilled and relentless.? That is why he had a combined 16 sacks in the regular season and playoffs last year.? That should divert blockers away from the edges, allowing Matthews to feast on more quarterbacks than ever before.

Rookie ? Jonathan Franklin

Make no mistake.? Write it down.? Eddie Lacy may get the press but the rookie running back that will have the greatest impact for the Packers in 2013 is Jonathan Franklin.? The young man out of UCLA is a much better fit for their system.? Not only is he compact and deceptively powerful, making it easy to run between the tackles, he is also fast and a proven receiver out of the backfield.? He?s also cleared up a bad fumbling issue that dogged him throughout college.? Once head coach Mike McCarthy realizes fully what he has, Franklin should see the field a lot, whether Lacy is in shape or not.

Sleeper ? Nick Perry

Somewhat of a forgotten man among Green Bay Packers fans.? The 2012 first round pick had a decent start to his rookie season with two sacks but watched it all come crashing down when a wrist injury landed him on injured reserve after just six games.? The team has high hopes for him going into 2013 and like Matthews he should reap the benefits of Datone Jones joining the front.? The lingering question is can he adapt to the 3-4 alignment and excel.? An answer will come fairly soon, and the fans will make sure they don?t forget him again.

(CNN) -- Dressed in a tan suit and an orange shirt matching his mom's bouquet, 2-year-old Logan looked on as his parents exchanged vows and rings at a back yard wedding.

Guests who gathered under a white arbor in the Jeanette, Pennsylvania, home applauded -- but many with tears in their eyes.

Because this union of Christine Swidorsky and Sean Stevenson was no ordinary wedding.

The couple had planned it for ages, and had penciled July 2014 as their special day. But that was before they learned that their best man -- 2-year-old Logan -- had just weeks to live.

The boy is suffering from leukemia, brought on by a genetic disorder Fanconi anemia.

"We've been waiting for this day for a long time, but under the circumstances with Logan being sick all the time, we just held off," Stevenson told CNN affiliate KDKA. "We always knew he was going to get better."

"But under the circumstances of what the doctors told us, we just decided to go ahead and do it while he was still with us."

Christine Swidorsky carried Logan down the aisle. His grandmother cradled her in his arms, his favorite brown teddy bear by his side.

"This is our dream come true, all our family together, and we're all together celebrating. The celebration of my son's life and the celebration of our marriage," Swidorsky said, as Etta James' "At Last" played in the background.

Fighting since birth

Born on October 22, 2010, Logan weighed just three pounds. Eating troubles kept Logan in the hospital, but he kept fighting, kept growing, and was soon home with his parents and his two older sisters.

And for his first year, he grew, he was healthy, and he made his family unspeakably happy. Even today, as his life nears an end, Swidorsky struggles to find words to say what an amazing little boy he is.

Just after Logan's first birthday, Swidorsky noticed that he wasn't feeling well again, and his lips and fingernails had turned white. Over the course of a month, she took Logan to the pediatrician four times before the head pediatrician tended to him. When he did, he quickly called 911.

Swidorsky said Logan shocked doctors at Children's Hospital of Pittsburgh. His leukemia had progressed so far, they were surprised he was still alive. Chemotherapy was started right away, taking an extraordinary toll on his body.

The couple learned more devastating news shortly after: Logan has a genetic disorder called Fanconi anemia, which most frequently results in death, most commonly from cancer, between the ages of 25 and 30.

But Logan fought hard, just like he had done as a newborn. He landed in the ICU but pulled through, and by July 13, 2012, doctors were prepared to give him a blood stem cell transplant.

After his stem cell treatment, he was free of leukemia for nine months, eating and acting like any other child. Life started to feel normal for Logan's family.

But Swidorsky's gut feeling returned when she saw Logan acting strange again.

Cancer again

It was cancer again: a mass the size of an orange on Logan's larger and better-functioning kidney. Doctors had no choice but to remove the kidney, just a week before Easter this year.

Life gained a long-sought-after normalcy for Logan and the family, except for the twice-weekly visits to a clinic for his chemotherapy. The therapy, though not a perfect solution for Logan, would hopefully prevent a recurrence of the cancer, despite being a lower dose than average.

Logan's life continued to improve.

"He was eating bowl after bowl" of spaghetti, Swidorsky said. "It was a wonderful feeling."

But then he started getting fevers and throwing up.

Logan's left side swelled as the mass returned, where the kidney once was.

"I thought he was doing so well. It's like you take two steps forward, 15 back," Swidorsky said.

The doctors told Logan's family that they could only do more harm than good.

In June, as the family's fortunes continued to fail, the Make a Wish Foundation treated them to a trip to Disney World.

But after just four hours there, Logan was back in the hospital.

Eight days of torture ensued, as he had developed an infection and eventually needed to be flown home to Jeannette, about 40 minutes from Pittsburgh.

Finally, on July 26, doctors gave Logan one to two weeks to live.

Not giving up

But that doesn't mean Logan's parents are giving up.

"We're just blessed everyday that he's here with us," Stevenson said Saturday, after the ceremony. "We're not going to stop fighting. We have nothing to lose.

"I'm going to try until God says otherwise."

Group: Israel expands subsidies to settlements

JERUSALEM (AP) ? The Israeli Cabinet on Sunday expanded its list of West Bank settlements eligible for government subsidies, a decision that came just days after the resumption of long-frozen peace talks and drew quick Palestinian condemnation.

The Cabinet approved a range of housing subsidies and loans for more than 600 Israeli communities deemed "national priority areas," expanding an earlier list. The list includes poor towns in Israel's outlying areas, but also dozens of settlements.

The Palestinians want to establish a state in the West Bank, Gaza and east Jerusalem ? lands Israel captured in 1967 ? and renewed talks are to draw Israel's borders with such a state. Since 1967, Israel has built dozens of settlements on war-won land ? deemed illegal by most of the international community ? that are home to some 560,000 Israelis.

Israel's government hopes to encourage more people to move to the communities on the "national priorities" list. The last version of the list was approved in 2012.

The Israeli anti-settlement group Peace Now said the list approved Sunday increased the total number of settlements eligible for subsidies from 85 to 91, virtually all in areas Israel would likely have to evacuate to make way for a Palestinian state.

Lior Amihai of Peace Now said three of the settlements added to the list had begun as rogue settlements that were established without formal government consent and then legalized retroactively.

Hanan Ashrawi, a member of the Palestinian negotiating team, said Sunday's vote affirms Palestinian suspicions that Israel seeks the diplomatic shield of negotiations, without being willing to reach an actual partition deal.

"This is exactly what Israel wants, have a process for its own sake, and at the same time have a free hand to destroy the objective of the process," he said. "This will have a destructive impact (on the talks), and it seems to me it's up to the sponsors, the United States and the international community, to make Israel desist immediately."

Israeli government spokesman Mark Regev said that in the case of settlements, any housing or infrastructure subsidies require additional government approval.

Four Israeli ministers abstained from the Cabinet vote, citing the potential harm to negotiations.

"To include settlements that until recently were illegal, when it's doubtful that they will remain a part of Israel, and to disproportionately invest in them ? I think it is not the time, politically speaking and socioeconomically speaking," Environment Minister Amir Peretz told Israel Radio.

Peace negotiations began in Washington last week, and will continue in Jerusalem next week. The U.S. wants a deal on the terms of a Palestinian state within nine months.

As part of the talks, Israel is to free 26 long-held Palestinian prisoners on Aug. 13, chief Palestinian negotiator Saeb Erekat. It would be the first of four groups of a total of 104 veteran prisoners to be freed over the next few months.

The release is part of a U.S.-brokered deal that cleared the way for the resumption of talks.

Police: Driver was DWI in burning truck with no front tires

Drunken driving charges have been filed against a southern New Jersey man who authorities say was driving a box truck that was on fire and missing its front tires.

Lakehurst police tell the Asbury Park Press that 36-year-old Michael Newmon of Manchester was hanging partially out of the cab window because of a shattered windshield when he was stopped around 3 a.m. Saturday.

Authorities say the truck had tree branches caught in it, with fire and smoke coming from below.

Because the truck was driven on its rims, police followed the marks left in the road and traced Newmon's journey about 15 miles to the Route 70/Route 72 circle in Burlington County. They found the truck had driven across the circle, struck a tree and drove through bushes.

We've all been there. It's pouring rain, and you're umbrella-less. Maybe you forgot your umbrella at home, or maybe you haven't purchased a new once since that last storm reduced your old (and favorite) umbrella to bits of shredded cloth and a broken post. High school football rivalries are not something that alumni often forget about and most would jump at the opportunity to play in the big game just one more time.

On Sept. 28, the alumni of in-city rivals Dearborn High and Fordson will face off in their first alumni game.

The game is scheduled for a 7 p.m. kick off at Dearborn High School, the night after the annual high school matchup.

The idea came from another alumni game, the Trenton-Woodhaven matchup Downriver that was played on July 27. Representatives at Alumni Football USA approached the athletic directors at each school after those involved with the first game mentioned the Dearborn-Fordson rivalry.

?I called Jeff at Fordson, and we decided to give it a shot, not having any idea what might happen,? Dearborn athletic director Jeff Conway.

But big things did happen.

There are more than 100 players combined for both schools that have signed up so far and each team will be capped at 40 players.

Dearborn?s oldest alumnus signed up to play is from the class of 1973 and is 58 years old.

The game itself will be just like those the alumni played in high school all those years ago. Full contact, pads, helmets and tackles with regular football rules.

Alumni Football USA supplies the equipment, referees and game day set up, and players participate in a six week conditioning program with practices.

A fee of $100 is charged to each player who wishes to be on the roster and participate in the game.

Each school will use the opportunity as a fundraiser for their respective athletic departments. Pre-sale tickets are $10, with $5 going back to the school of the seller. The remainder of the money and game-day ticket sales go to Alumni Football USA.

Dearborn will also get to keep the concession money from the night as the host school.

It is rumored that a TV crew will be at the game and a rematch next year at Fordson is already in the works.

Although it is a big rivalry between the schools, it might be the first chance for some of the older alumni to face each other.

There was a period of time when the two schools were in separate leagues and did not face each other. Since then the Western Wayne Athletic Conference and the Mega Conference have absorbed the teams and the game between the two is one of the most anticipated all season.

?A lot of that is because Dearborn is such a great community with a sense of family,? Conway said. ?Our kids see each other at the park, at the gym, at the mall, so that familiarity makes for great competition.

?Social media helps too, with the kids spreading excitement each year on Twitter, Facebook (and) Instagram. By the time kickoff rolls around, it?s pretty much a powder keg ready to blow with the biggest crowd of the season.?

As the seasons pass, alumni from each school keep the rivalry alive and well and the current coaches and players keep on top of things, reminding the underclassmen of the one game they want to win each year.

?That?s the Dearborn vs. Fordson game,? Conway said. ?It?s very cool stuff, and it?s also great that after the game, the players and coaches can shake hands, have a hug, give a high-five and leave it on the field.?

The two teams have even faced each other in the MHSAA state playoffs the last two seasons with the regular season loser winning the playoff game each time.

The rivalry is a big one and Conway is looking forward to the chance for alumni to take to the field one more time.

?My personal opinion is that this should be a great event,? Conway said. ?It will bring lots of people out, help out each school with a little money and give kids an opportunity to see their dads play one more time, or even play with them, wives to see their husbands play.

?(It will) just make for a lot of fun and laughs for all those involved.?

Chinese immigrant pleads guilty in baby's death

INDIANAPOLIS (AP) -- A Chinese immigrant charged with killing her baby by eating rat poison while she was pregnant pleaded guilty Friday to a misdemeanor count of criminal recklessness as part of a deal with prosecutors.

Bei Bei Shuai, 36, pleaded guilty to criminal recklessness and was sentenced to time served, which was 178 days, Marion County Prosecutor Terry Curry said in a telephone interview with The Associated Press. Charges of murder and feticide were dropped.

Curry said he decided to accept the lesser charge because a number of evidentiary rulings by the court had hurt the prosecution's case. He says he decided to accept the lesser charge rather than to appeal those decisions.

"There were evidentiary rulings that would have made our case difficult to proceed," he said. "We felt it was appropriate to resolve it with the plea and with some acknowledgement of culpability and everyone can move on."

A message was left at the office of Shuai's attorney, Linda Pence, by the AP late Friday afternoon seeking comment.

Prosecutors had argued that Shuai, a Shanghai native, killed her child by eating rat poison in December 2010, when she was eight months pregnant. Shuai gave birth to Angel on Dec. 31. The baby died three days later.

Among the rulings that hurt the prosecution's case was one in January when a judge ruled that Dr. Jolene Clouse, who performed the autopsy on newborn Angel Shuai, didn't consider other possible causes for the brain bleeding that caused her death, including a drug that Shuai received while she was in the hospital.

The case drew international attention from reproductive rights advocates who contended it could set a precedent by which pregnant women could be prosecuted for smoking or other behavior that authorities deem dangerous to their unborn child. About 80 organizations have filed friend-of-the-court briefs on Shuai's behalf, and more than 10,000 people from Australia to New York have signed an online petition supporting her.

But Curry said those arguments weren't a factor in the case.

"While well-intended, those assertions have been completely incorrect from the start. There was never any intention to monitor pregnancies. As has been pointed out on more than one occasion, Indiana appellate courts have already weighed in on those issues," he said.

The plea agreement states that the two sides believe the conviction "will not trigger adverse immigration consequences," and if it does the plea agreement will be set aside.

The trial was scheduled to begin Sept. 3.
